Disclosure Scotland Delays at who's coat?

So, a certain contractor agreed to three weeks delay to process vetting and Disclosure Scotland. They had all details within 24 hours.
It's now four weeks and still waiting....with every day costing dear due to the publicised Disclosure Scotland backlog.

Morally he has waited long enough. The employer has five years references etc. And it's all checked out. The agreed start date is now a week ago ( plus the initial agreed three = four weeks total cost)

He can't afford the delays and thinks they should start paying according to promised contract.

Any thoughts fellow contractors?

If a condition of you providing services is that you have a DBS check in place, and you don't have a DBS check back, then you have not met the conditions required to provide services and invoice for them.

Say you have it and then turn up at the client, they undoubtedly will not ask to see it as has happened twice to me before.

If the contract allows the contractor to invoice for not doing any work, then invoice (and check the IR35 insurance and position carefully).

If it does not, then either terminate the contract or wait for the current one to start.
