I'm not having this LG. The Private Eye stuff was fine - public domain.

Public dobbing IR insider contact news most certainly was not.

The IR insider news is of concern to all contractors, not just PCG members. If they want to claim to be representative then they should be happy with this stuff going public.
They should have put it on their public pages with their views on the subject.

Otherwise they are an unrepresentative members only club and should have no voice as far as contractors are concerned.
I am not qualified to give the above advice!

It's also that none of the posts are verified as bonafide. It's just people's opinion/thoughts/rumors.

It's not something that they could publish in a press release as it's all unofficial.

I do use the forums (fora?) but the advise is, as usual, worth what you paid for it.

Stuff like this should be made public. It seems petty for them to keep such information as members only.
That was a private post containing hearsay on a private forum. How could a quasi-official organisation be seen to condone or validate such a post - get real!

The PCG has set itself up as the "official" voice of contracting.
A rumour like this is bound to get out and as it occured on their fora they have a duty to all contractors, including their members, to research the rumour and publish on it.
If they can not do such a thing then they should back away from the table and stop claiming to be the voice of contracting.

IR35 is the reason the PCG formed, it is the single biggest issue for contractors and a rumour like this is either great news or very dangerous to all of us. How can teh PCG sit back and say it is nothing to do with them.

                common sense

This always comes up every so often. I'm not taking sides but if you were a tax inspector who would you want to investigate ?

One company takes 14k salary and 10k dividends.
Another takes 4k salary (no minimum wage for directors) and 20k dividends.

Both have taken the same structure and done things proper.
Both companies have taken 24k but as a tax inspector who would you go after if you had a choice ?

Like the thread said, if there are fewer inspectors, they would probably ignore the first group and concentrate more on the second. Isn't that just common sense ?

Also, I don't have my insurance papers handy but it covers the investigation costs. Not the tax + interest, penalties, etc. (Your ploicy may be different.)
It boils down to what you're comfortable with for the level of risk.

A crap example just to highlight what a few have already said. There is no proof what the inspectors do.

IR35 is not dead (has anybody from the Government said so officially) just ready to be "re-interpreted" when Gordon Clown gets into no. 10. Always have your defenses ready.

With all due respect, I don't think that they have ever said that.

The point is, this the conversation has no more substance than any other unsubstantiated rumour. As such, it should be given no more credence than it deserves.

Now stop ranting and off with you laddie.

Lets not lose sight of who the enemy is. Nu Labour.

As long as all IT contractors remember this, do what they can to bring the downfall of this disgraceful regime, that's all that matters.

IR35 may be a lame duck, but Dawn Primarolo still carries the belief we should somehow be made to pay for being successful small businesses.

The point is that this rumour is likely to have one of two effects.
                      1. People will believe it and start ignorring IR35.
                      2. People will ignore it and continue with their IR35 defences.

Either way the PCG should be trying to find out and make an official statement.
This rumour is dangerous. The PCG claims to be our voice. This needs addressing.

Oh yes, and **** off with the patronising little throw aways.
