      On my last gig, me and another contractor were out having a cig and discussing both of our IR35 investigations, when out pops a contractor (an old timer at that) who's been at that Client Co seven years. He then tells us that he's IR35 proof 'because HMRC are scared of his accountant'. ******' spangle. He couldn't be convinced otherwise. He reckoned it didn't apply to him because he'd never been perm and his 'accountant could just sort it out anyway'.

      Some people don't live in the real world.

        I don't see why. You agent is not going to bring this up and if you go with a local accountant they might not either.

          I replaced another long term contractor at one client, and he'd been investigated. My new manager told me that HMRC kept requesting to come and see him to discuss this contractors working arrangements etc., and he just kept telling them he was too busy and "eventually they went away".

          Which shows how important it is to have your client on your side.
          Will work inside IR35. Or for food.

              Was speaking to the other contractor at client co last week. He said he doesn't need to worry about IR35 because he got a certificate from HMRC in 2002 saying he was exempt.

              If they ever come after him, he's going to show them that certificate, apparently!!!

                You seem to be implying that just having insurance is not a good thing.
                I only have insurance (the full QDOS). Do I still need to be afraid?

                  If you do absolutely nothing about understanding IR35 and do not bother trying to act like a company then yes, you should be afraid. Insurance alone is not the answer.

                      I have a reasonable understanding of IR35, and have taken steps to be outside it. But I don't really know if I AM outside it. But if the insurance pays out everything to do with the tax, including any back tax, do I need to be worried and if so why?
