I would hazard a guess that IR35 is buggered in this case. If the OP is soft enough to agree to lose their notice period so readily I think it would be a given they would bow to the client and be directed IMO.Originally posted by TheFaQQer View Post
a horrid pointer to being inside IR35 if you get paid for doing no work'CUK forum personality of 2011 - Winner - Yes really!!!!

I'm not sure that those go hand-in-hand, to be honest.Originally posted by northernladuk View PostI would hazard a guess that IR35 is buggered in this case. If the client asked me to change my notice period, then I'm not fussed, really - I believe in getting paid for the work I do, and not getting paid for work that I don't do. If they started to dictate how I did my work, then it becomes a different matter completely.Comment

Be a bit of a bonus to be paid for the 10 days as well....Originally posted by malvolio View PostHate to rain on everyone's parade here, but if the client or the agency want you out, they won't invoke the notice period clause, they'll use the one about immediate termination without compensation. The OP has been treated fairly, nobody needed to give him the extra 10 days.

If you've actually turned up at site though couldnt you argue that they've still got to pay you for that day?Originally posted by Spacecadet View PostWhat immediate termination clause? Have you seen Bless'ems contract?
And no, he has not been treated fairly, there is feck all he can do about it since he agreed to the change though!
And as for they don't have to pay you if there is no work to do: If you're in a contract where you can walk in one morning to be told "sorry, there's no more work for you" and yuo can't argue back as yuor tasks are doled out to you each day then chances are the nature of your work puts you inside IR35.
If you've been taken on for a specific project then unless someone has magically finished everything overnight, you will see the end of the project coming and if it is being finished early then your exit can be planned gracefully.
If the company suddenly wants to change requirements and find they do not want you then they can either pay an early termination charge or take you on (with a new contract) to work on the new project.Rhyddid i lofnod psychocandy!!!!Comment
