Gaza belonged to Israel by virtue of capturing it when Egypt invaded just like Judea and Samaria from the Jordanians.
Israel offered it to Gazans in exchange for peace the Gazan's (Government,Terrorists , UN employees and individual citizens) then invaded them.
They therefore lost Gaza to Israel. Legally Israel can do what they want with the land, Israel gained it legally.
The population may be more problematic. Moving them might seem to be ethnic cleansing but that is quite common round there - how many Jews are in Muslim states?
I'm not sure I would want a neighbour that wanted to rape my family, cut their heads off or burn them to death. Do try to fix this that is the obstacle to peace.
