      Maybe I've missed it but what was the notice period in the contract?

        It was an odd one, at the start of the contract it was a week, this then increased to a fortnight then in December it became a month. Also just to add to the joy a one month break starting 16th December. I phoned to resign on 16th having started a new contract. I emailed later the same day.

          1 month notice starting December 16th = Finish date January 16th.

          Don't know how to break it to you but it seems they may be in the right....

              Yep but the break started on December 13th. You served notice on December 16/17th....

              Break finishes on Jan 13th. Notice finishes Jan 16/17
