    What is the latest: Working in Germany 2012

    Apologies , I know this matter has been dealt with many times , but i cant find any latest or relevant information for 2012 using the search thing.

    I have an interview lined up for a possible contract in Germany would need to guidance in regards to the latest tax laws or limitations or what are things to consider. The Job is in dusseldorf.

    Don't do it

    The law here is not black and white, there is no right and wrong.
    Even with a tax accountant - declaring every cent of my income in 2006 and 2007 today I received a letter from the Finanzamt telling me I owe them another 20K.
    The reason - they haven't checked if my house in the UK (which I paid for each month) was really a place I intended to go back and live in.
    Sick of this - Sick of Germany and want to leave, Do yourself a favour and find a contract somewhere else (especially if your contract would be in Munich)

      Could you explain that? What has your house in the UK got to do with it? Or should I say, what difference does it make whether you intend to go back to it? I'm assuming you're paying German tax on rental income, but where does the extra 20k come from?

        Because he used a scheme that wasn't quite on the straight and narrow and instead of blaming the providers (or even himself for being greedy and gullible for getting into it in the first place), he's blaming the tax authorities.

        The house bit probably had to something do with the scheme.

          If you evade tax and get caught then the taxman of the country you have evaded tax in will chase you.

          In some cases the taxman of the country you resident in will be helpful in aiding this foreign taxman to chase you.

          Even in some cases if it's to fine you for not putting in a zero tax return.

            In Germany you are allowed to deduct expenses to travel to your second home - In my case in the UK where my partner lived. You can deduct your rent on your German property as well. I had a huge mortgage flew back every week - and now 5 years later they say these expenses cannot be deducted. They also charge interest of almost 5K on the sum of tax they now want to charge me. An accountant submitted my taxes - this was all clear at the time - I have no alternative other than to go into another lengthy legal battle in kangaroo court to try and get some money back.

              No dodgy schemes - just a full tax return of all income - all declared and a huge bill to dispute.

                  It all started with the scheme from ITS and MM - I gave it up years ago - the accounts they question are ones that were fully declared in Germany - nothing wrong at all.
                  The way they treat contractors who used schemes such as those from ITS is crazy.

                    I suspect much like how HMRC would like to treat past and present users of offshore schemes over here...once you're on the radar, it's probably next to impossible to get out of the way of the Eye...
