    Long term temps entitled to redundancy?

    Been with my job for almost six years now,(as a temp/through my own ltd co) and rumours the job is to go within weeks.

    Wondering if the length of service entitles me to some sort of redundancy payout if the job goes as I've heard this from a few people, that length of service can almost qualify you as permanent. But then others say it is contract specific and you are not necessarily entitled to redundancy?

    You are employed by your Ltd Co, not its customer.

    Is your Ltd making you redundant?

    No, thought not.

      And if I wasn't employed through the LTD, I'd be employed through a job agency, as most temps are.

      So not directly employed by the client.

        I refer back to the "is your Ltd Co making you redundant".

        The answer is No. Therefore the answer to redundancy is also No.

        Doesn't matter how any other people work it, its how you work is that's the issue.

          If you are employed by your LTD, that's it.

          If you want redundancy take a look at the AWR legislation coming out in October.

          I would image that 99.99% of contractors on this board will make an effort not to in caught by it (mainly by working through their own LTDs).

              It's all starting to make sense now. We have even been given a possible end date of 30th September!!!

              I assume temping and contracting jobs will be very scarce from October too then?

                  Nope.

                  Temps will be provided with protection.

                  Contractors will see themselves as businesses and avoid getting caught.

                    It is quite difficult to see what employers can gain from employing any non permanent staff for more than a three month period from 1st October. Will employers really check or insist that potential employees are ltd rather than temps?

                    I assume if my employers are getting jittery about this others will follow suit.
