    IR35 Compliant?

    Agency claiming to be "IR35 Compliant"....so is that in or out?

    "Here are some of the perks you'll enjoy as an associate:

    • IR35 compliant - we pay for QDOS, QDOS follow-ups and your background check"
    Are they saying they have QDOS cover for any outside investigation?
    I know I should probably just ask them, but was wondering if anyone had seen this kind of thing before from an agency?

    There is no such thing as IR35 compliant. All they are trying to say is that they take the correct steps to ensure IR35 is applied properly. They use QDOS services to ensure they've done their diligence on the SDS, contract and the work. I've lost track of what to do with IR35 as it's now the clients problem if they've made the decision in the SDS but I'd still be doing my own diligence on what I need to be safe. Not sure if that includes contract reviews and TLC35 nowadays though.

    I doesn't mean QDOS will cover an investigation but in this day and age that risk sits with the client as they produced an SDS and have taken on the responsibility but I'm out of touch of what the proper steps are.

    They are just trying to differentiate themselves from some shoddy setup that doesn't have a clue about IR35.

      It also doesn't mean they have a great clue about it either, but that they are aware it exists, and have a contact name at QDOS.

        Leaving aside the "IR35 Compliant" question, I'm more interested in what they mean by "associate", especially when it's combined with "flexible working". That makes them sound more like a consultancy, i.e. you'd be working for them and then they'd send you off to their clients.

          Reading between the lines - the gig is outside, they have had QDOS assistance in writing the contract. Though check who the liability really rests with as the end client may be a managed service via a relatively small agency - meaning you are liable and should still do your own checks (you'll be the only person in such a scenario that they've encountered who will ask to do this though)
