    Day 1 Rights - IR35

    Agency have asked me to declare whether I've been provided with Day 1 Rights or not, I'm thinking "no" as the contract is outside of IR35?
    Any views?

    the fact the agency are asking suggests it might not be outside IR35.

          so you *think* you're outside... it remains to be seen depending on the next few weeks, whether you are or not. And the client gets too choose prior to their first payment (not your first payment). Answer very carefully.

            Why don't you ring them and ask them what it means? How are we supposed to know what the question means and what you are supposed to have?

            Have you been given a signed SDS stating your IR35 status?

              What does you status determination document tell you - you should have one from the end client / agency saying that the contract is outside. If you don't.....
