I have been working direct (with no agency) with a well known IT Consultancy company in the UK and just about to finish my current project for their client based in the UK.
This same IT Consultancy company in the UK now offer me a role to work on the other project run by them. The end client is a large business in Netherlands. They do not have UK business operations or branches. The contract will be between my company and a well known IT Consultancy company in the UK. I have the following questions:
1. Considering coming change to IR35 rules whose responsibility would it be to define the status of my contract in the coming fiscal year? Is that me or this well known UK IT Consultancy I work with?
2. Since I will be based in the UK but will be delivering my work in Netherlands is there anything I need to do about data handling, data protection, data access, etc. as effectively I will be moving data between UK and Netherlands in order to carry out my work (e.g. produce design artifacts, build and configure systems, etc.)?
3. Since I will be based in the UK but will be delivering my work in Netherlands do I need to appoint a representative of my own company in Netherlands and to register there as a self-employed and to form NL LTD company?
4. How would taxation matters work considering this set up? Do I have to pay taxes where I delivered my work (NL)? I am going to be full time remote with 1 trip to their office every 2 months.
5. Am I missing anything else when considering this engagement?
