This seems like the project is run by the consultancy not the Dutch client, therefore this is a UK project even though there will be a delivery to a Dutch client.

There shouldn't be any need to register any business in the Netherlands.

    1. The consultancy after April
    2. No. the consultancy will have responsibility as a data processor. Only if they ask you to be a data processor as an independent company will you need to be concerned (they won't)
    3. No
    4. UK. The end client to you is the UK consultancy. And you will be working in the UK only. Occasional trips to the EU won;t change that.

If the middle man is in the UK - the UK consultancy arm - and your contract is with the UK consultancy arm then everything should be under a country in the UK's legal jurisdiction e.g. England and Wales, Scotland or Northern Ireland.

Until you see your contract you won't be able to determine things like GDPR though currently the UK hasn't diverted from European legislation.

Personally as you have an ongoing relationship with them I would ask them if the contract will change significantly, and if so to send you a template contract to check things like GDPR.

  • IT Contract in Netherlands - Hoes does that work considering Brexit and Covid

I have been working direct (with no agency) with a well known IT Consultancy company in the UK and just about to finish my current project for their client based in the UK.

This same IT Consultancy company in the UK now offer me a role to work on the other project run by them. The end client is a large business in Netherlands. They do not have UK business operations or branches. The contract will be between my company and a well known IT Consultancy company in the UK. I have the following questions:
    1. Considering coming change to IR35 rules whose responsibility would it be to define the status of my contract in the coming fiscal year? Is that me or this well known UK IT Consultancy I work with?
    2. Since I will be based in the UK but will be delivering my work in Netherlands is there anything I need to do about data handling, data protection, data access, etc. as effectively I will be moving data between UK and Netherlands in order to carry out my work (e.g. produce design artifacts, build and configure systems, etc.)?
    3. Since I will be based in the UK but will be delivering my work in Netherlands do I need to appoint a representative of my own company in Netherlands and to register there as a self-employed and to form NL LTD company?
    4. How would taxation matters work considering this set up? Do I have to pay taxes where I delivered my work (NL)? I am going to be full time remote with 1 trip to their office every 2 months.
    5. Am I missing anything else when considering this engagement?

    Thanks

Working...
