    IR35 reportedly amended to exclude wholly overseas organisations..?

    Apologies if this has been posted elsewhere already:-

    Government IR35 Review: Little Solace for Contractors as HMRC Doubles Down

    "In one major change, the government said it will “amend the legislation to exclude wholly overseas organisations with no UK presence from having to consider the off-payroll working rules… this means the individual’s limited company will continue to determine the status of the individual”."

          That isn’t what they’re proposing. The small company provisions aka BAU will apply to fully overseas supply chains. The PSC remains responsible and liable. Obviously, we await the amended draft legislation.

            Perhaps I misread the intention of your OP though. Anyway, BAU, no exemptions from IR35.

              Brexit aside, what's to stop somebody setting up a company in Spain and that company enters into a contract with a London bank, then the work is actually sub-contracted to a UK PSC. Spanish firm invoices London bank. UK PSC invoices Spanish firm. Bit more complexity and expense but why would this not work?

                See through rules allow HMRC and any tax tribunal to ignore the offshore bits if required.

                    More madness. That setup would mean I still operate a UK company, still contribute to the UK tax system and economy. The alternative is just selling up in the UK, moving here (Malaga) and setting up a Spanish company. What's the difference flying into London for 3 days on site vs taking the train down from Northern England? Probably cheaper.
