Whilst I agree we should remain on track and focussed regarding BN66, the comparison of our situation with Maria Miller's high profile case (being assessed under 'the rules as they stood' pre 2009) is very pertinent, has potential leverage and is well worth pursuing via NTRT lobbying and further letters to MPs. This is an excellent opportunity to cause further embarassment to the government in the final year before the next election.

At the moment I have no idea how the first tier tribunal is going. Or how our complaint about HMRC is going.

I believe DR is not available this week, so I will try and answer...

As I see it, there are two issues related to our campaign at the moment:

1) Section 58.
2) Proposed legislation for Accelerated Payment Notices.

No.2 can be triggered by a tax scheme (such as ours) being registered under DOTAS, at which point it could be "game over" for fighting S58.

The debate about MP's morals is a side issue, but may be useful in our lobbying effort, considering that HMRC/Gauke/courts are pursuing us on moral grounds rather than applying the law as it stood before 2008.

Obviously, EBT related posts should be kept off this thread.

For clarification, my comment did not have anything to do with DOTAS. I was pointing out the double standards adopted by this governement regarding the treatment of ourselves (s58) and Maria Miller et al (MPs' expenses). I believe this could provide valuable ammunition to our case.

Indeed, but both Helen7 and Brillopad saw these as distractions to s58.

I have been trying meditation as recommended by a work colleague. Apparently according to Buddhism all problems are only temporary. Well s58 is now 6 years old. With no end in sight. This should not be allowed. I feel like seeing an insolvency practitioner and declaring myself bankrupt - assuming this would put a stop to the HMRC aggro.

Also, isn't it time for a new thread? No-one is ever going to read through 5000+ posts. This one is 2 years old now.

I received a letter from my MP at the weekend in response to the latest toolkit letter, in which she confirms here ongoing support for our cause, and will write to Judith Knott of HMRC demanding answers to our pertinent questions.

The fight goes on.
