Just sent off my Letter.

I still do not understand why HMRC did not take people to a Tax Tribunal many many years ago. I can only conclude that they were not sure of winning but by changing the rules now believe they are in a much better position.

That's a terrible argument. It's not "fair" for a wife to find out her husband has been having an affair, or downloading illegal child porn, but life isn't fair and things don't work that way.

I can just see HMRC accepting all my assets being transferred into her sole name as completely above board and not trying to avoid a liability, what a ridiculous suggestion! The government are quite happy to throw the "fair" argument around in terms of amount of tax payable, so why cant we?

Using your argument maybe we should tell the government "life isnt fair and things dont work that way Mr Gauke so just suck it up"

MY entire argument on fairness is based around the passage of time and retro action, it took them 8 years to implement the retro action, that is NOT fair in most peoples book.

Im sure there would be many people shouting "fairness" from the rooftops is PSC's had retro action going back some 8 years to change the landscape so more people got caught by IR35. And Im not the kind of individual to snigger in the corner saying "you got what you deserved" if that did ever happen I would be sympathetic.

PS - the parallel between child porn and adultery is a terrible argument, this is a government agency we are dealing with here, not some seedy sex antics.

Some people will say it won't count if everyone sends similar letters but HMRC will have to report to the Minister how many responses they got. So every letter does count.

Hope some of this counts or something as after writing countless letters to my MP and visiting him in his office nothing seems to be going our way ..

At least with this latest nonsense we've got our act together before it's become law. As we know, it's very hard to get laws undone.

I don't think HMRC will be very happy that NTRT and Whitehouse have become involved.

I'm guessing HMRC couldn't come after a casino for cash if you blew it all prior to collection, or go and demand Porsche refund a car at full price because you bought one a few months in advance,. So, what if you lost all your money in a series of transactions? Those could include a bit of gambling, maybe some bets with people (mates, wife, etc.) Perhaps you then blew the rest of the money, perhaps the products / services you purchased were offered by a company. Perhaps your wife owns that company by total coincidence, unbeknown to you!?

I would not for one moment advocate anything that would deny HMRC their "fair share", I do think they should get their fair share of whatever you have left, even if that is sweet, sweet FA
