Left client due to his conduct towards me, now threatens me

    im sure they will and expect that. but again, only did what my accountant told me for the IR35 stuff.

    anyway irrespective of that, I would still hope that he cant really sue me/file me for compensation especially since the work was done (ahead of time) even after advising against his request but still continued to do it, and that the contract is with me and the agency and him and the agency.

      Of course he can't, as has already been said to you several times.

      Just stay calm, bill for the hours and see what happens. The agency will want paying too so they get their cut. If you are concerned about your reputation then worse thing IMHO would be to just roll over. Personally I would pass it on to a debt agency and expend my energy on looking for the next gig instead.

          Regarding payment...i get paid weekly from the agency. I just got paid for last week.

          I think usually agency pays contractors first then persue payment from client

                  just an update to you all.

                  got myself another contract. had the interview today, they gave me an offer, i accepted. even though it is a paycut from what I was getting, still.... its a contract and certainly hope (and wont) become what became last time.


                  I asked regarding if they heard anything from that ex client and he just said that he was chasing after payments etc... but "nothing to worry about. promise me"

                    Brilliant news. Well done.

                    I remember I had a clause in a contract once that stated if there was a 'breakdown in the relationship with the client' then no notice was required. Just a thought.

                      no such thing but funny you just replied as I looked at something on the "confirmation" of the signed contract:

                      Notice Period for Contractor to terminate Assignment: The Contract has no provision of notice for the duration of the contract.
                      Notice Period for <Agency> to terminate Assignment: <Agency> may give 1 days notice at any time until xxx xxx Feb 2012, 7 days there after

                      highlighted in bold means.... ?


                      update: reading the "booklet" of the t&c it does state:

                      The Contractor shall be liable for any and all loss, damage or injury to any party howsoever arising (whether directly or indirectly)
                      and resulting from any breach of this Agreement or any deliberate or negligent act or omission of the Representative or any
                      assignee or sub-contractor to whom the Contractor assigns or sub-contracts the performance of the Services during the
                      Assignment.

                      Where the Contractor or Representative is in breach of this Agreement which results in the Client terminating the agreement
                      between Premier and the Client or the Assignment, the Contractor shall without prejudice to any other remedy of <Agency>, indemnify
                      <Agency> for any loss of profit relating to the remaining portion of the Assignment Period.
