    Call to action!

    It's interesting that this thread has had over 321,000 views. There are 3000 people affected by this tax, yet it's the same few posters that we see on the forum.

    Well done to all those who have written to or seen their MPs. But to those of you lurking in the shadows, hitting the refresh button every few hours will not help.

    You owe it to yourselves and your families to write letters and visit your MP's surgery in person.

      I've written to my MP asking for help in holding HMRC to their statement in open court that they would wait until the end of the legal process before enforcing collection, pointing out that all parties knew that this would most likely end in Europe. Whether he will come up with any help or not is anyone's guess, but for those still to write to their MPs, this is worth highlighting. It gives MPs a way to support us where they would otherwise have backed off, because they don't want to be seen as condoning tax avoidance. We're playing for time now.

      Email to Treasury Committee sent as well.

        I can't understand people who won't write a letter or send an email.

        So what if it's a waste of time.

        If you can't be bothered to make any effort to help yourself then why should anyone care if you go bankrupt or lose your home.

          Where are all these 3000?

          E-mailed my MP - with a response promising some follow-up - plus e-mailed Treasury Committee. Looking to pay a visit to MPs surgery in person as well. Still cannot help feel where are the other 90% who are affected by this - we need to hear your voices and better still see some action from you. Don't just sit there and wait for others to fight the cause for you.

            I know people who were in the scheme, who dont know about this thread and depend on MP for information.

            Some people who were in the scheme for a short time wont have big exposure so can reluctantly pay what they owe. The fact there are not 3000 contractors contributing to this thread is a tacit indicator to this imo.

            I wasnt going to bother writing a letter to my M.P. until I thought what the heck. I can afford to pay but the retrospective interest is just so wrong it made me think again.

              MP Sales Pitch

              I just dug out my literature from the original MP sales pitch for the scheme, as well as a shiny brochure there is an comparision of income sheet that has three columns in the illustration:-

              income ( subject to IR35 ) - Scheme ( unsuccessful ) - Scheme ( sucessful )

              the scheme unsucessful column shows the same tax payable as subject to IR35 pretty much, but interestingly shows blanks for NI contributions. The point being is that the scheme was sold in such a way that we were lead to believe that fallback position would not include NI, which of course it has been included on the CNs issued.

              Could this represent that the scheme was mis-sold ?

                  Lurked for a long time, first post, I have written to my MP in the past and just mailed him to make an appointment, letter to Treasury committee on its way.

                  Are we still on for ECHR and date for Tax tribunals 2013 ?

                    Not really - retrospection is a time machine - all bets are off when this happens.

                    The current DTA scheme was either new or it was a modificaiton of the Padmore scheme. When the Padmore scheme was closed retrospective legislation was used but it was used in a way that meant that no one paid any more tax. The retrospection simply prevented people who had not made a claim from then making one.

                    It is HMRC who are at fault here - they have misrepresented the Padmore legislation (which they did not even mention to us prior to section 58) to Parliament in order to get section 58 enacted. That complaint can only be made to your Member of Parliament.

                    If you haven't written already, get your quill out. If you have, write again to David Gauke, George Osbourn, David Cameron, Nick Clegg, and to the Treasury Select Committee who are holding an enquiry into retrospective legislation.

                    We'll probably all have HMRCs next tax demand by the end of the month - this is five minutes to midnight.
