Service Company Question in Personal Self assessment

    talking about the 09-10 SA return, not P35.

    My accountant has automatically added the amount of divis from my company into the "service companies" box on my SA, despite me being outside of IR35. I'm not sure this is right. Any views?

      Reluctantly, I think your accountant is probably right to do so. HMRC are entitled to ask questions about your tax affairs and the basis of your income as part of your SA return, and you are obliged to answer them. So, even if you don't like the implied question (are you or have you ever been inside IR35?), you are still obliged to answer the ACTUAL question (do you receive income via a company that you are a shareholder in, in respect of services that you personally provided on behalf of the company).

      On this one I take a different view to Malvolio - I think that the question is clear enough, and you are obliged to answer it on its own merits.

      However, it is not the same thing as acknowledging that your services were provided within IR35.
      Plan A is located just about here.
      If that doesn't work, then there's always plan B

        My accountant has automatically left this section empty.

        They are one that specialises in IT contractors and are PCG accredited.

            Doesn't affect me anymore (retired - SNEER!) but I thought they were supposed to have clarified this question. Maybe clarifying is a bit much to expect from HMRC.

              Seeing as I'm doing sod all I thought I'd do my 2009-2010 SA, quite shocking to see those tiny figures in black and white.

              So what are we all putting down for that stupid, ambiguous question this year?

                  Just finishing off my tax return and I thought I'd let you know that I've filled this box in with the Salary + Dividends I received from the Ltd Co. I'm not entirely happy to do so but the question is clear enough so it's not easy to avoid. I do however believe that the motive is very, very sinister.

                    Just about to do my SA, whats the general view with this questions now, even though I was outside of IR35 do I need to stick in the divs and salary ? My accountant tickets YES to me being a PSC on the P35.

                      As I understand it the declaration of your IR35 status on your self-assessment is mandatory and stating you are outside will then result in a letter asking you to prove it
