I applied for my refund 2 weeks ago and asked for money to be transfered into my bank account. I got a reference number for the request, but thats about it, no transfer, no update. Can I charge them interest on monies owing ? I may have to send the boys round and if they don't pay I may apply for a bankruptancy order against HMRC.

Me too, only about £10 but this was 2 months ago, still no cash has appeared ! Useless bunch of people.

Yes. It focused on 3 people who have been harshly treated by HMRC interspersed by interviews with David Hartnett, head of HMRC.

One was the Aberdeen businessman who got hounded out of business, and made bankrupt. Eventually he received compensation of £50k but reckoned he had lost £300k - £400k. Joke was that the bankruptcy hadn't been overturned and he couldn't bank the cheque.

Another guy just kept getting letters saying he owed ever increasing amounts even though his accountant kept calling HMRC and sending letters. That went on 8 months, them saying he owed £15k when they owed him £800!! He got compensation of ...wait for it... £25.

Third guy got mistreated over severance pay - but then if you must be a permie. His compensation ...£50.

Hartnett didn't really accept that anything was wrong or that compensation should be paid out of the public purse. Its not difficult to see where Brannigan gets his attitude from - Hartnett's was certainly straight out of the F**k you bible.

Maitland intends to run more shows on HMRC but it didn't really unearth anything that we haven't seen for ourselves and there was no sense that the world will change as a result of it.

not sure if anyone noticed but right at the end ITV suggested anyone else who has stories of SH*T HMRC treatment should get in touich with the tonight programme, what dya reckon guys?? Should we do it??

There is a thing called the repayment supplement actually. (Though I think this is changing this year to make it evewn more in HMRC's favour).

It's a good idea, but we need someone who really stands to be bankrupted and not afraid of publicity in front of friends and family. That counts me out I'm afraid

Me too...

I am just about to submit a claim for a refund of overpaid tax in 2007/8. Having spoken to MontP, there is a chance that this will be declined on the grounds that money is owing in previous years ie. the closure notices.

This has not happened in all cases where clients have tried to claim a refund, and as is usual with HMRC, there is no consistency.

However, this is something to watch out for. If you do overpay tax, don't bank on getting it back.

DR. I had the same problem last week. HMRC currently say I have overpaid by nearly 4K, and they are withholding the refund because of the ongoing dispute. I'm going to have word with my accountant and see if I can withhold PAYE/NI payments in lieu of the money they are holding back.

I dont think we need to wait til someone is bankrupted, I think we could as a group state the intentions of HMRC and the injustice. Its a bit late for anyone to stop the process if we wait til were bankrupted! We could be anonymous
