The Government can just ignore the ruling.
In theory this may be true but in reality I can't see them simply ignoring it. I suspect initially they would try and appeal.

I wonder what an incoming Tory government would do if this was still going on?

Perhaps our energy would be better spent trying to get rid of Brown & Co.

It is highly likely we will have a Tory government from May 2010 and I can't see a resolution before then.

        Apparently

some poor sod had the Bailiffs turn up at his gaff today, even though he'd been assured only yesterday by the inspector that payment had been postponed!!!

Also, Mr B and sidekick if you are reading this. Get off your lazy arses and answer the phone.

Just heard that someone at montp spent the last hour and a half trying to sort out some poor sod.... he had the bailiffs turn up at his house today for monies which montp had been assured by the inspector yesterday had been stood over (postponed!).

HMRC are not taking calls .... they know this is montp's busiest time of the year... but they are doing NOTHING to help this process.

            More Questions

I did as someone on this forum suggested and went on-line to check my tax returns for the years that I was with MontP. Nothing shown as owing. Is that because the CNs haven't been issued yet?

I was fully expecting YKW to do the usual trick of issuing the CNs just before Christmas, just to spoil my festive season, but to my surprise nothing turned up.

Do we know what percentage of MontP members have received CNs? Does it depend which local tax office area you come under?

As of a week or so ago, only about 1/3rd of clients had received CNs. God knows why it's taking them so long but just maybe they realise it's a pointless exercise.

My God!...this makes me so effing angry...this is disgusting...I can imagine few worse scenarios...bailiffs are not by nature people who will listen...

It is the courts that decide enforcement. Could a court decide the law is against UK HR Act, and yet enforce it? Any cases where this has happened?

If the government did not accept the ruling of the courts then that is a serious constitutional problem. Only a very strong government would dare take that on. We don't have a strong government.

In theory, I don't think there is anything stopping HMRC proceeding to the Commissioners with our appeals but they are probably reluctant to do that in light of the JR. In any case, I'm sure the Commissioners have no shortage of other appeals to hear, and it's not like any of us are complaining about the delay!!!
I'm not sure about that. Would a commissioner not have to suspend the case till the court has their say - in the same way a lower court waits for a higher court?

Just show the Bailiffs copies of your closure notices and deny them entry.
I also asked the revenue for a letter stating I owe nothing, so I will just show that if they come knocking.

If that fails, pour a bucket of cold water over them from first floor window. That would probably work and it should turn their clothing to ice in this weather
