    Hello all,

    I posted the following a few days ago, but as my first post, by the time it was moderated it was pages back so not sure if many saw it.

    I spoke with MontP last week, The opinion now is that the JR won't take place until February at the earliest as the courts are busy with JRs relating to criminal legislation, so we wait.

      by the time the JR takes place we'll have had a general election. Brown bounce my arse. If you want to get rid of these crooks, lets start a campaign 'Lie to the Pollsters', soon as he thinks he can win he'll call it, the opportunistic b**d.

        First time so be gentle with me...

        Hello One and All,

        I've been lurking here for a couple of months now. First of all, thank-you to (nearly) everyone who has posted - it has in general been very informative.

        I have come out of the shadows as I received my CN's last Friday. Interestingly among the CN's I have a tax bill for 2 years where my Tax Return should, in theory not have been re-opened.

        In 2003 there was no enquiry made on my return, and in 2004 the enquiry was sent to my old address as nobody at the Revenue had bothered to update my records (I sent them a letter). I was told at the time by MP that this effectively meant that no enquiry was made.

        Some of the threads recently stated that they can only open previous Tax Returns if an enquiry was made, but I am clearly not in this position and am wondering if anyone else has received a CN for a "closed" Tax Return. MP have said that they should not have done this, but we will wait and see the outcome.

        Keep up the good work everyone, and hopefully we can all have a celebratory drink when we finally win.

          I thought JR had to take place inside 3 months?

          I guess government can twist the rules to suit their own needs........

            No, I think it was that the JR had to be applied for within 3 months of the legislation coming into force (late July).

            Presumably there is some sort of vetting process to prevent any tom, dick or harry applying for a JR. Can we take it that, since HMRC have been given notice, then the JR has been approved pending a date? Or is that a bit premature?

                Out of the closet

                Hi - just wanted to make myself known and thanks to all the posts that have get me up to date. Have been with MTM continuously from 2002 .... so you can imagine the impact if this goes against us.
                Received the "newsletter" but no closure notice yet. Also taken out a CTD for part of the amount, the rest in an offset mortgage.

                    Where CN's were issued for an out of date year, Montp were appealing to HMRC on the basis that they can FOAD.

                    Montp have done this in a number of cases - at least 100 over last 4 years but HMRC have never ever come back to montp.

                    Montp reckon it's more ammo though against HMRC.

                      I must admit I'll be very interested to see how the pre-opened "discovery assessments" pan out. I got done over by this some years ago and still reckon it was wrong. More fool me for capitulating though.
