    There are a lot of victims generally from management schemes, in back tax etc, and abroad in Europe a lot of contactors have been affected by schemes not working. This is just a special case.

    Whatever scheme you´re on it can be attacked, sometimes its legal sometimes it isn´t and sometimes the scheme runs off with your money.

    Hopefully on this particular loophole, you can win your case.

    But on general note I wouldn´t touch a scheme with a barge pole.

      And you are quite right : we should consider the views of other groups. Alas the threads have attracted a few trolls. Mostly in the early days.

      cuk attracts alot of trolls. BB has had a go at me on other threads and I believe the only reason for his prescence here was to have ago at us as a group but particularly me.
      Can't argue with that. Though recently my view on the potential retrospection has changed.

      Originally I though it was probably ok to at least try the retrospection back to 2004/5; I felt the disclosure rule meant everybody had effectively been put on notice. I am finding it increasingly difficult to reconcile that view with our governements current actions on other things they are clamping down on. It does seem somewhat unreasonable when they are clarifying certain aspects of CT reliefs having become aware there was some "abuse", but they seem to have no intention of seeking to go back.

      I guess they recoginse that corporate business may well afford even more bigger and expensive lawyers than HMRC.

          JR oral hearing

          The date of the oral hearing, to decide if the JR can go ahead or not, has been confirmed as:

          16th June


          It will probably take place in London but time and location won't be confirmed until nearer the day.

          The hearing will last at most 30 minutes. It is unlikely that the Judge will give a decision there and then.

                    The Treasury acknowledged they were aware of two JR applications in a recent response. The only other JR I'm aware of is PwC and there's no date yet for their hearing.

                    I think either MontP were misinformed or PwC's hearing has been delayed.

                    Unless there is something I don't know about, it looks like we are up first.
