OMG!!! That is quite unbelievable! ...these guys are a law to themselves!!!

I am sure that this is going to happen again...have MP advised what the procedure is here if the men in suits turn up at your door?...what powers do they have?...eg do they have powers of entry?

In speaking to MP they have suggested that a CTD (certificate of tax deposit) may be preferable & that approx. 15% of people with MP have taken this up. I just wanted to know if anyone here has done so & what are the risks & issues (if any). Money is supposed to be held without prejudice, but as an HMRC scheme this seems a little strange to me. I am eager to avoid the 7.5% interest that HMRC will charge on any monies owing if they win. Any comments here greatly appreciated.

Also if MP win the JR am I right in saying that monies will only be owed on income from March 31st 2008 onwards?

Thanks All - I have found this forum excellent
welcome to the forum and thanks for de-lurking! Nearly missed your post!

Anyone here got a CTD yet?

I can assure you that the money will be safe - you can get it back anytime you like. **if** you are lucky to have the money around then if depends on your attitude to risk. you can earn interest more elsewhere - but you want to stop the clock ticking. personally I would take the CTD - but I am becoming more and more risk averse!

Also - as DR keeps saying - only get a CTD for the tax you owe - NOT the interest!

JR is just the first step - HMRC can appeal it. Its quite a long process - dont hold your breath!

As from March 8th 2008 montp switched to loan scheme. Personally I dont like that (and I have a large enough double tax exposure) so I have now gone limited.

Has anybody checked with Montp to ensure our presence will not hurt the case?

Is their anything that can be learnt from the failed IR35 appeals? Did that go to a JR? I understand that IR35 was contensted on human rights violations.
Good point. When we get a date I will ask montp if there is any reason we should not show.

As per my earlier post - I think the judge will love it! But I could be wrong....

Anyone know if this person who got the home visit had been issued with a CN previously? Would this be a pre-requisite?

I just spoke with Montp to check they had received my CNs and they are going to appeal in the next few days. Apparently the Debt Recovery office is a bit disorganised to day the least and the they came round in error. As long as you appeal within 30 days there should be no problem.

                Yes he had received CNs.
MP appealed against them within a couple of days.
                HMRC then acknowledged the appeals.

A week or so later the heavy mob turned up at his door.

This is why I have no CN yet ...

Following HMRC's very informative newsletter, I called MontP to check the status of my accounts, and was informed that mine have not been sent to HMRC yet, they are still being prepared by their accountants !?!

Not sure if I am in the minority here, or how many other peoples accounts have not even been submitted yet. Maybe this is the reason for low number of thuds on the doormatt??

BTW - A friend of mine has had a CN with figures for 07/08 accounts ESTIMATED, as the SA has not even been filed yet for this tax year. Sounds like the figures were scribbled on the form by someone with a writing age of a 4 year old. Very professional !!

                      New

Hi there I am new to this - recommended by Mad-Dog who is known to DR.

I have been on scheme from 2004 until 2008 and I got a CN last Saturday for all four years. I have purchased CTD - savings gone but I have included the interest as I thought they would try and claim interest on interest. I noticed the comment about not getting a CTD for the interest in a previous post but I have no background about this.... can someone please fill me in?

Also on my CN they have included an amount for 2007/08 (or at least that is what MP have told me it is for). This amount is based on 06/07 numbers but there is NO reference on my CN that this is for 2007/08. Are they trying this on with everyone? Do I need a CTD for that amount as well?

I have also had pencilled figures calculated on my CN - which for such an official letter I think is appalling!

Their bully boy tactics have been disgusting. Fight it all the way. How dare they.
