    Access to the NTRT private forum

        2005 Discovery

        Just trawling through my paperwork for the TAA stuff and I found the CN's , however I have CN's for 2003,2004 and 2006 with discovery for 2005, for 2005 it says I did not declare my trust income and thereofre they will consider seeking penalties. I always used Monty for my tax returns, hence has anyone else had this? I very much doubt that we didnt declare the trust income as monty where on the ball for this, hence wondering if this is just another HMRC oversight.

        On a +ve note I dont have CN for 2002 which was a year they didnt enquire in time, they subsequently tried and monty sent them the rebutal and I note that there is a 0 balance on my 2002 statement so maybe they've copped that one, although they will probably fire up the time machine to find someway of getting that in.

            Check your 2005 tax return to see if it includes the trust income in the Foreign Income section.

            If Montpelier filed your return I would find it hard to believe they didn't include this.

              It may be because the DOTAS number's not on there - I've had 06 and 07 opened via discovery for this reason and MP are, supposedly, challenging this although my recent correspondence with them suggests they might not be continuing with this for reasons unknown...

                I have had something similar - Tax year ending 08 was my last year with MP and there was only 4 months worth to declare. Since the scheme was already being investigated, I decided to submit my SA with all income as self employed (As per HMRC's recommendation). ie No foreign income. 3 years later, I received a CN for this tax year with the foreign income added to it again. Effectively taxing me twice. MP have appealed against this (2yrs ago), but I can still see the amount online as suspended. So far APN's received for 2006 and 2007.

                Summited all three CN's to TAA - Hopefully they can clear this up.
