Doesn't the FOI act cover this? if they hold info about when letters to me were created they need to provide that if I ask surely? (i'm sure the server time stamps are beyond hector to manipulate - but given we will be in the hands of their service provider to deliver this I'm not overly optimistic).

But not if it's covered by Whistleblowing legislation. Going public with evidence of corruption, incompetance, malpractice in public office etc would more than likely fall under that remit.

There would still be consequences to be dealt with but fines, jail time etc would not be part of it.

That's exactly the point I was making earlier. There must be some kind of stamp on the files showing "create date" and "modify date". Possibly even a document management system with a history on each file.

I haven't worked in HMRC so I don't know what systems they have in place but I would have thought they would have to have a minimum amount of data handling of this nature.

If you are in any doubt that HMRC opened an enquiry for a tax year send this letter to HMRC

I have no record of HMRC opening an enquiry for this year.

That being the case, I hereby request that you withdraw the Closure Notice.

If they write back enclosing a copy of an enquiry letter:
1) if you didn't previously receive it, ask yourself if it looks fabricated
2) if it is the same as a previous letter, check that it exactly matches the original

It was a computer error, it was an accidental mistake or maybe the dog did it.
