    I said earlier that I believe it is misfaesance. They should be sacked and proscuted.

    but that doesn't, of itself, help the individual taxpayer concerned.

      I'm not so sure about that. The only thing the original letter says about 2006/7 is:

      "Given this you may now wish to submit an amended return for 2006-2007 to reflect that the partnership income is chargeable."

      That doesn't really constitute opening an enquiry. Also, you can't amend your return once it's under enquiry.

      Adding the following letter heading (in bold) changes the context, and weakens the taxpayer's position.

      "Section 9a TMA 1970 Notice"

      The letter was a fairly standard letter issued to many taxpayers after the legislation came in, so there could be a large amount of tax at stake.

      The letter the taxpayer sent to HMRC gave the impression that the taxpayer didn't have the original.

      There may be an innocent explanation but it's a bit fishy.
