As both a deGraaf and MTM user this is certainly of interest to me, especially as I'm already in the 2nd month of my 3 month deGraaf APN ticking time bomb...

If it's OK I have a few questions that you might be able to help me with:

1. Is it worth waiting until I have read the imminent newsletter (re: George) or is this as I suspect of no relevance to the APNs that we are now being sent?

2. Have any JRs been completed so far to show that they can/do indeed halt the APN process, even if only temporarily, or is this yet to be proven?

3. I assume that Mall Hall @ Saleos really will complete the actions that he is describing and that this won't become a 'false hope' that just tails off with Matt having collected potentially a large number of £900's from us? I guess I'm nervous about paying almost a thousand pounds to someone I don't know, with potential addition unspecified further funding required!

I understand that you may not know the answers to these, but any help would as always be appreciated.

3. the Saleos JR is going ahead even if no-one signs up. The JR is being carried out for schemes he already represents with 3,000 users. All they've done now is open this up for other people to participate.

Make sure you understand the risks.

1) being party to a JR should prevent HMRC enforcing APNs
2) but it might not prevent penalties being added*


* 5% if you don't pay by the APN due date + another 5% five months later + a further 5% six months after that

In other words you could end up with 15% penalties added to the APNs.

Thanks, and I do understand. The problem is that this APN is c.£45K, but it's only the first APN...

So as my total is >£130K I am simply unable to cover them - via APN or final payments. Hence the need to find a way to buy some time (at £900 + £???) to either bite the bullet and sell the family house to release equity or see if the George/Agency solution can work for us.

Remember, the bulk of this is being funded by the 3,000 user schemes Saleos is already representing. They would need a contribution from a substantial number of these 3,000 to take the JR any further. Asking you for more money wouldn't make much difference.

One thing it might be worth doing is asking Montpelier if they could include your deGraaf APNs, along with the Montpelier ones, in their JR. Can't hurt to ask.

Incidentally, I understand Montpelier are sending out a letter this week regarding what they are doing about APNs.

Got my notification of impending APN on March 27th, letter dated March 13th. It mentioned 1 - 6 weeks before the APN arrives.

And good point on Montpelier - I'll ask them as I used both their scheme (so APNs for that will undoubtedly arrive at some point) as well as deGraaf. I asume that both schemes would have been the same so hopefully my deG one will just be another APN added to the list alongside any I have for MTM.

There might be different grounds for contesting APNs with the two schemes because of variations in the structure and starting dates, specifically around DOTAS.

Oh, and in case anyone is curious about why I would move from one scheme provider to another, the agency I was with at that time (Reed - I don't mind 'outing' them) discovered that quite a few of their contract employees were using these schemes and insisted that we moved to deGraaf with whom they 'had an arrangement'.

Don't have to be Einstein to work what that 'arrangement' was do you...

About as much point asking Reed for any compensation (as they recommended that I use the deGraaf scheme) is there is trying to track down the original deGraaf scheme promoters.

You are not alone, mate! many here know the feeling.... Yes, some (those abandoned by the scheme promoters) have been less lucky than others, but at the end of the day we are where we are: all in the same boat, and targets of the same aggression. There is strength in numbers, everyone should form or join a group to fight back if at all possible. NTRT is a shining example of what can be achieved when people join forces for a cause. Remember that the last thing the bully wants is for all the little cogs to assemble into a sizeable fighting machine.
