I hope Gauke is dragged by his hair to justify to the implication that HMRC always win anyway. Hopefully he will be forced to resign for basically concocting this.

I am patiently waiting for the newsletter and sure this isnt the only part of the equation however:

Any debt can become statute barred if you have not made a payment towards it and have not acknowledged that you owe the money during the relevant time period (6 years for most debts and 12 years for mortgage debt).
Even debts owed where you have not actually borrowed the money such as Council tax and HMRC arrears can become statute barred under section 9 of the Limitation Act which covers amounts due under statute.
However it is important to be aware that normally a creditor will take action against you to collect the debt that they are owed before enough time has passed to allow it to become statute barred.
is that valid for income tax as well as NICs - too much info out there - some sources seem to say only valid for NI but not for income tax .. guess we await the newsletter.

have managed to persuade 2 more people to join NTRT as well.

Hope that's not the central plank else it means anyone who has taken a CTD could be scuppered!

        Probably best not to speculate.

George isn't anything to do with debts or statute barred. We haven't even got a debt at the moment. There is an amount in dispute but payment is suspended pending appeal.

I realise I can't stop people speculating but you'd be better off waiting to read the CCW letter.

By the way, when you have the letter please do not pick over it on this forum.

I am certain HMRC are pouring over everything that is said here for any crumbs that could help them.

Well if HMRC are listening, there's a big steaming pile of turd coming their way.

            Happy solar eclipse Friday!

Government outlines new offences in evasion clampdown

See the below latest outpouring from the Ginger Twat (aka Danny Alexander), and I can say that quite comfortably being Scottish, and a bit of a ginge! Given the article below, perhaps this is one for every MP, Tax Professional and the Legal Eagles out there, to now define exactly was is evasion and avoidance, the below seems to allude to just having offshore accounts! Given the mire that has been created over the two, there now definitely needs to be clarity.

"TAX EVADERS and professionals who aid and abet them will face a raft of new sanctions including two new criminal offences and higher penalties, the Treasury has confirmed.

The new regime, which targets those who hold offshore accounts, introduces the controversial strict liability offence, meaning it's no longer possible to plead ignorance in an attempt to avoid criminal prosecution.

It will also be a criminal offence for corporates to fail to prevent tax evasion or the facilitation of tax evasion on their watch.

An increase in the financial penalties for evasion will link the penalty to the value of the asset kept in an offshore bank account for the first time.

Civil penalties for those who enable evasion will see them face the same penalty as the tax evader.

Announcing the move, chief secretary to the Treasury Danny Alexander said: "We're making it a crime if companies fail to put in place measures to stop economic crime happening in their organisations. We're also making sure that the penalties on those that facilitate evasion are large enough to punish and deter.

"Tax evasion is a crime like any other. If people help a burglar, they are accomplices and criminals too. Now it will be the same for those that help tax evaders."

                      Just joined NTRT

Hi guys, just discovered the forum and have just joined up to NTRT. I am a long time MP customer and wish I'd discovered the forum ages ago. A real source of help and the reassurance that I'm not alone - I don't get a lot of advice from MP. Thanks
