    early years say 30 days after the penalty hits and total 10% - later years say from the day its due. Ring up the APN team and ask if they have stood over the amts .... if they have you dont have to pay till 30 days after you get the response to your representation . SO if you had some money you could juggle and pay later years first to avoid penalties ... also it is my understanding that if they are stood over (mtm rep accepted and begin looked at) you couldn't pay them even if you wanted to

      It depends...

      Which tax year was it?

      There are several Montpelier letter templates. Which one did they get you to send?

        HMRC can only issue an APN if there is an open enquiry or an appeal against a closed enquiry. If neither of these conditions apply to you, then you have good grounds for objecting to any APN.

          As I read it, if you have made representations then you have 30 days to pay from the date HMRC reject them. So as long as you have made representations as to why the APN does not apply within the 90 days you don't have to pay HMRC by the end of 90 days if they haven't responded.

            Except not all of the Montpelier templates are valid representations.

            HMRC have rejected the 06/07 & 07/08 ones, which refer to judicial review, and held people to the original due date of the APNs.

              I disputed my 05/06 APN (due 6th July) using the MTM template by recorded delivery on 26th April.

              I'd heard nothing so phoned HRMC yesterday. They confirmed receipt of letter but are still reviewing the reasons for withdrawal, however collection is suspended until they finish their review.

              Shame they don't let you know that in writing.....

                When to pay.... Yuck.

                I'm the same for 2004/5 and 2005/6. I've not heard anything and due to pay on 30th June. My letters have not been responded to. Assume I have extra 30 days for these years? Or should I phone APN team to make sure?

                  Im in the same boat and spoke to them yesterday and they say its suspeneded... but my view is when it is me it will cost 5/10k im afriad I want written confirmation ... after all its a one way risk

                    They are writing back immediately if the letter doesn't constitute a valid representation.

                    But I guess it wouldn't hurt to phone them and check they have received your letters.

                      I was told that whilst they where looking at my letters the payment was suspended - but then a day later they wrote to me saying they didn't accept the pending judicial review as a reason and I still have to pay on Jun 8th as previously stated (i.e. I didn't get the extra 30 days which would have been helpful)

                      Currently scrabbling around for the cash as we speak - hoping to join the TAA but cant afford the initial payment until I get paid next!
