Odd that HMRC would allow an enforceable debt to exist which they appear willing to do nothing about, i.e. allow penalties/surcharges to be applied over time rather than collect – puts a black mark against your credit score but that’s about it, in the short term at least…..
My understanding is not paying an APN is the same as not paying a tax demand.

Penalties get applied over time, while enforcement is taking place, until the debt is recovered.

The only question is how far HMRC will actually go to enforce an APN. Unlike a normal tax demand, they may stop short of bankrupting people. But even Gauke said, during the debate, that this couldn't be ruled out.

I would urge you to read this:

In the absence of a government meantime, now is the time to act, before they get the chance to lie to their new political masters and get some new draconian retrospective powers passed in the next finance act. Torpedos eins, zwei, drei und vier, los!
Especially if Labour and SNP get in.

If that happens a text message should be enough for them to get new retro tax laws passed.

TAA Effects on MP and Class Action

I would be interested in anyone's views on this post by Helen 7. Right now I am still a MP client and still contracting through a PSC now.

I am keen to support this NTRT strategy and be part of it, but I need to understand any impact on MP, and my current PSC freelance business.

Also, as a new NTRT member, in terms of DR's post about TAA class action, I am assuming that I would be eligible as I was in the DTA scheme since 2003 till it was closed, but there was a loan element to it, I seem to recall.

And again a big thanks to this forum/DR/NTRT for giving me at least a little hope!

Have MTM been consulted on this? After all, they are currently fighting (and funding) our legal fight.

        1. Could applying for TAA affect the tax support offered to us by MTM?
        2. Since TAA effectivly puts the tax liability to MTM (of sorts) are they supportive of this course of action? or could it affect the legal work currently being pursued by them?

What we are doing is completely separate from what MP are doing. This has been covered in recent newsletters.

The agency legislation is a totally separate part of the taxing acts than either S58 or IR35.

DR - thanks, but I do know this is separate from MPs actions - that's why I asked the question. I was interested in whether anyone had any views on helen7's post as it has relevance to my own situation. Apologies if this isn't the right forum topic or if the answers are in a newsletter, if so perhaps you might be so good as to point me in the correct direction.

                      Thanks in advance
