At the end of the day, if the agency will not deal with an offshore company (for whatever reason, or for no reason at all), then you have the choice to either work via a method they will accept or walk away and find someone who will let you use the invoicing vehicle of your choice.

If you aren't prepared to walk away, then there is obviously a limit of how far to try this line - you'd look pretty silly if you threatened to walk and then were forced into a humiliating climb-down, and it would weaken your position somewhat in any other discussions you might have with the agency.

And the agency will go for the less hassle / risk option - someone with a UK Ltd.

It isn't an immediate red flag for us, although I can only think of a handful of cases where we have agreed to it. We'd look at the individual circumstances of each situation. As Lisa has pointed out there is a lot of fear and ignorance around the implications of the recent legislation, so not surprised that firms are taking a blanket approach here.

Could you please update us on your case? We are in a similar situation: non-UK citizens not based in the UK with a non-UK company looking to bid for contract in the UK. Also, is it possible to raise some sort of discrimination case against agenise refusing to operate with non-UK companies?

Isn't it more plausible they don't want to work with a non UK company because that company doesn't appear to know how to run properly and is asking random questions of banned posters on an internet board?

But I can tell you straight away that it is not possible to sue an agency for not working with a non-UK company. They are simply doing business according to their own risk management.

Thank you for replying to my post and sorry if my posts have upset you. I am only trying to find people in a similar situation to ours who could share their experience. But by replying to old post I hope that the persons who posted the relevant question in the first place will get a notification that there is a new message on their thread and will come back with a reply. I thought that this was a preferred way of doing it, rather than opening a new thread.

So far, accountancy firms that we have contacted (including recommended by you in one of your threads SJD) say they only operate with UK-based companies. Also why do you think you need to file a case against UK agencies? I thought Gideon was open to taking brown covers to open up the full UK to offshore?
