    You are aware you can be a director of a company and not take any money out for that tax year? Or take your expenses and also just put some of the money in your pension?

    Also if you make your wife the director and not yourself as well it looks like you are doing it for dodgy reasons e.g. banned from being a director, and as you will be in control of the company you will be considered a director anyway.

    Does your wife actually use this company? Is she a contractor or does she do nothing for this business and it's come kind of shell set up? Is this company legit or no so?

    With so little information it seems a bit cloak and dagger and smacks of something going on you aren't telling us? Did you take MVL and thinking if you are not a director then you can go back outside again or something?

    Isn't there an issue with you bringing all the income in yet you get the money via your wife so potential aggressive tax avoidance going on?

    I could have this totally wrong but we aren't really in the business of giving advice on evasion so some background would be nice.

    I also thought agents wouldn't deal with people who aren't the main shareholder. If the agent is engaging with your wifes company it should be her that's dealing with them no?

    That is not correct. They will work with an umbrella company where the director is not the person doing the work

    1) Why can't you be a director of the company?
    2) Why don't you want to be a director?

    And

    3) No agency will work with a company where the director is not the person doing the work - that way lies real risk for them.

  • Contracting through LTD company without being Director

    I am about to sign an outside IR35 contract, can I work through a limited company where only my wife is the sole director? Also I will have some PAYE income coming in for 1 year, so I also don't want to take any salary or dividends? I want to have an employee contract with £1 salary and RSUs vested over next years.
