Having expressed my displeasure to the agency, and pointed out that my company wouldn't be paying, I have now been allowed by the end client to complete the survey without charge. I suppose I should let their HR manager out of the cellar now then ;-)

Hi, this is incorrect actually. Paystream are offering a determination tool but they will insist the end client actually answers the questions to provide a determination.Originally posted by craigy1874 View PostPaystream doing IR35 determinations? Oh dear...
I thought it had to be done by the end client anyway?
On another note, does anyone know who's responsibility it is to pass on the determination to the PSC? Is it client to agency then to PSC or does the client tell the contractor and agency at the same time?

Accountant logic - Because a tickbox exercise that took 2 minutes which we called an IR35 compliance review was a good way of convincing people to use us rather than another accountancy firm.Originally posted by NobbyClark View PostBecause an IR35 compliance review was included as part of the accountancy package that I purchased.

You / they should be using a legislation specialist for determination, if you do end up coughing up for it at least tell them to use a proper company (like Qdos, IPSE etc.).

Funny how all the contractor accountants offer 'IR35 reviews'. This should be left to employment status specialists IMO.

Where else is offering everyone a replacement contract that is outside IR35? Granted the deal isn't perfect but I can see their logic (even though it's up to the end client to determine status).Originally posted by NobbyClark View PostOption 4.
