SJD contract review

That was my point - in the past I just sent them the contract and got an e-mail back with advice. This time they replied instructing me to complete some kind of review-o-matic series of questions which anyone could answer if they read the contract (the questions are about the contract not practises).

Go to QDOS and they will review the whole contract and even negotiate any clauses that they deem might put you inside IR35.

I've had some annoying admin mixups with SJD recently, I wouldn't recommend them to do an IR35 review unless it's from a specialist lawyer.

I asked SJD for a contract review and they sent me a mail inviting me to fill in a load of questions on a sort of review-a-matic thing that looks like their version of CEST - it asks me if the contract has various provisions. Am I being unfair in thinking that if I wanted to review my own contract I could do?

If they're asking you to give your interpretation of the contract, then, yes, throw it back at them - it sounds like that what they're mean to be doing.

But if they're asking what your daily working practices are with your client, then that is entirely valid, and probably more important than what is in the contract, should you ever be investigated by HMRC.

Perhaps they are simply ensuring the contract aligns to reality? That said, I wouldn't trust SJD to run a whelk stall these days. Go to the experts.

I think you are wrong in the statement about reviewing your own contract as well. IMO you should always get a specialist to do it for your piece of mind and to be able to prove diligence when it all goes wrong.

I think you are wrong in the statement about reviewing your own contract as well. IMO you should always get a specialist to do it for your piece of mind and to be able to prove diligence when it all goes wrong.

I also think asking SJD to do it isn't the best way. They are accountants offering a bolt on service. I would have gone to QDOS, Baur & Cottrell and the like for an independent review from a specialist.

With IR35 looming and the determinations being made by the clients in the future you've got to expect this as well. Unless it's a small business where you can still be in charge of the determination then it's not your responsibility anymore. Other people are on the hook now so expect many more hoops to jump though.

You should, of course, always review your own contract for clauses that might pass review but matter to you. Notice periods, payment details, location etc etc.
