I cant see why the tribunal would agree they are able to do all of these things given their witnesses last week. This argument very much appears to be the law is broad, we can do what we want and this tribunal doesnt have the power to stop us. If that point is proven false they fall apart. If its true...

There was a point made early on last week about how legislation should be clear, there is absolutely zero way any of the clients could have possibly known there was even a chance the accountant was falling into this. So the outcomes for the clients would be very unfair. I would hope the judges can see...

Having watched all of this, if HMRC can spin a win out of this they are winning purely because they are HMRC and what they say goes. I have seen nothing compelling that makes me think otherwise.

Sounds like you are looking to reinvent the CRM. As a software dev contractor, I just kept my eye on opportunities coming up. Contracting days are over though. HMRC's aggressive attack on my accountant and branding me an MSC seen to that.

The boox advertising was a strong offence from them, but that is more likely to get them in hot water with trading standard than anything else unless they can prove they actually did do everything else, which they cant, because they didnt. It was false advertising, not tax evasion.

I am interested to see how HMRC present their argument. The argument itself always felt weak and a stretch, but on their side they had the fact they are HMRC.
The idea that the 'profiting on an on-going basis' box was ticked by a subscription, in a world where everything is a subscription.
