Turns out that the garage sent the V5 for the car I'm not buying off to the DVLA with my details....

Could be an extra bargaining chip should you wish to carry on with the purchase?

I had a BT engineer phone me up this morning to tell me that my phone was working which was a bit of a weird conversation.

Interesting situation.

Went to collect my new car with the paper work I was asked to bring (they are offering cheap finance so I was taking that as it allows me to keep the cash for the other stuff)...

Turned out I needed more paperwork than I was asked to bring but instead of saying sorry they just said you were told to bring that. That was about to descend into an argument so I just asked for my current car back (even though they filled in all the V5 stuff and I'll have to spend £25 on a new one)..

On a positive note, you are the legal owner of the new car and they CANNOT hold on to it no matter what happens to the old car. I know that you don't want the new one, but if someone w@nks about "legalities", you have their bollocks tightly squeezed in your hands.

I have all the V5 for my current / old car (they wanted to hold on to it for about 30 seconds until I said police). I will need to sort out a new one at some point so I can actually sell it...

The issue now comes down to:-

V5 on the new car is supposedly in my name. (I guess all will be revealed when it arrives in the post in a fortnight or so).
They are holding on to the deposit. However they have the car but cannot sell it as they aren't the registered keeper...

Sales manager has tried to speak to me once. When he rings back I will just say that I'm speaking to my company lawyer as to how to proceed...

We also have the typical sales trick of paperwork being signed electronically with no sign of the contract before I signed... If push comes to shove I can have fun with that as well..

The only question is do I torture the sales manager until he offers a whopping discount or just insist on a refund... I think I need to keep things ticking along until the V5 appears...

It does look like you got your priorities right. You are not linking the sale of Old car with the purchase of new one, which is the way it should be.

The two things that work to your advantage:

- The new car is registered in your name. In the eyes of the big brother, you are the OWNER of the car. You however do not have the car. It is unlawful possession on the part of the garage.
- Electronic signature. Well done!

The absolute worst you could lose is the deposit + some lawyer fees and still have the new car.

Depends on how you wish to treat these crooks. I will be tempted to give them misery before any more pennies go off my pocket!

Not strictly true, now is it? Since it was a finance deal the finance company will be the owners of the car.
The V5 shows the registered keeper, which is not the same thing at all.
