Just to let you guys know that I have been given my determination as outside IR35.
This isn't something that happened easily. And it isn't something that happened overnight. I've been planning for the new Off Payroll rules for at least 4 years, and even before then I've done my best to be outside. It's not easy, given the blurred lines that HMRC like to draw. Along with strong contract terms, I've had to enforce my 'outside' working conditions even though it's meant arguing with the client's IT director at times.
I had to educate the client and continue to force through all the evidence I had, to get the correct determination.
I've been at this client for 3 or so years now, each renewal with a specific, targeted objective. Contrary to the 'permitractor' jibes, the longer I have been here the more I have been wary of IR35 and the further I have worked myself into a position of independence from the client.
I'm at the tail end of my contracting career so this just helps me get over the line for the next few months. I have no idea what I will do after but it doesn't seem like there will be much of an economy left in the UK anyway.
