    Contract Screening

    Hey Guys,

    What are peoples thoughts on getting contracts checked for IR35 compliance? Obviously it's a good idea and should be done (I do) but I've got an interview today with a company and they have already determined it's outside IR35.

    The reason for this post is that due to the type of company it is I would be absolutely floored and amazed if they had gotten this determination wrong.

    My gut is telling me to get it vetted anyway but the potential speed they would want my bum on one of their seats might mean getting the vetting response after I need/have to start.

    It's outside

    So you aren't responsible especially as you haven't filled in any questionnaire related to the determination.

    Provided you've got the determination in writing from the company and the agency I think you are good to go.

      This was my take on it too. Just need to hive off the documentation as you say and carry on.

        Why would you not?

        It doesn't (usually) cost anything and if you are being rushed to start say Monday that would be a bigger red flag

          Because in a months time it isn't the OP's responsibilty and QDOS and the others screeners are all stupidly busy at the moment...

            I will still be getting my contracts checked with QDOS. No brainer for me. Something is going to change in the future so why not cover your ass if it costs (next to) nothing.

              Given the scenario where I pay for QDOS and they come back saying it's Inside IR35. What would then be the best way forward given the QDOS delays?

                I can't imagine this would be the case for one minute so a tad hypothetical to say the least. But.. If they do you go back to the client with why and either renegotiate or educated them on whatever it failed on.

                I'm sure someone will says it doesn't matter, risk is with the client but I don't think it's smart to start a gig knowing the SDS is incorrect.

                  Yes exactly. Even if they have done the determination the responsibility is still mine to cover my own ass.
