    Me, too, but when I started playing around with hypotheticals, I seemed to come up with several "outsides" with answer 1 which, everything else being the same, were "unable to determine" with answer 4. Seems ridiculous.

      Seems like the question about buying equipment is a key one, too. If you have to buy your own computer equipment, and can't expense it to your client, that seems to cancel out some other problems.

        In my case number 1 would hold true as I have specialised in a particular product for years and years.

        Now number 4 would usually be true, as would number 1. However, given the poor specifications written these days sometimes you do need to clarify or have input, but that is more about spec, rather than how it is done

          In fact, this is a silver bullet.

          I just answered "no" on 4-7, Yes without the worker's agreement on 8, the end client decides on 9-11, but if you answer "Equipment" on 12 it gives you an outside reading.

          Of course, it has to be equipment you didn't already own. So, get your client to write into the contract a requirement to buy the latest greatest laptop for you to work on and you're golden.

            But it doesn't hold true for existing equipment. I endeavour to use my own equipment (it's better than the tulip most clients give contractors) but I don't buy new equipment all the time. Last years laptop will do me until 2019 at the earliest....

                True, my current one is 4 years in, obviously as I'm 90% WFH I largely use my own stuff in any case.

                You don't spend a fortune on them to get rid of during the usual consumer life cycle.

                  Yep. Given a week and if you need an outside determination the appropriate people will know how to fill the form in correctly....
