IR35 PS - So anyone had the discussion yet?

But they could indemnify you against any losses if they say you are outside ir35 and then you aren't. Unlikely but I know a friend who claims that his new contract with an NHS trust has that protection in it.

But most people talking about a new contract (they'll be lucky) are hoping to continue working for the same organisation via the same agency. And that's a complete no no...

The team I'm on is all aware of it. We've not been officially told we're inside yet, but I think it's only a matter of time. Some of us are actively looking for new contracts, some seem to be sticking their heads in the sand and hoping everything will be alright.

Daft thing is, Summer could be a good time to move into PS if you've never worked in PS before. Potentially good rate, no retrospective issues, full negotiation on WFH in some departments, etc. , especially in light of the government department recommendations to up your rate to cover IR35.

I have an interview (telephone) next week with a PS body.
The agent told me IR35 is definitely outside as they are not part of FOI. He's wrong there as they are part of FOI.

I've told the agent that he needs to sort this before I'd take any role, and seeing as he (the agency) would have to pay the PAYE/NICs if inside they really need to know WTF is happening.

I've also explained to him that the PS body could rule me outside, but only in advance of the tool, and that I'd walk if it went pear-shaped.

I'm trying to get him on the phone to tell him to see his legal department before this causes grief.
