    Because the tool is a guide to help them make a decision but there are other factors the client has to consider and one of those is attitude to risk.

    Another factor is Incompetence as well sadly...

      Spot on - I told the client that was my take on things. Yes HR are wrong on the substitution business just based on presence of an agency, but it speaks volumes for their attitudes towards the rules. Apparently they'd done 50 assessments in a row and all deemed inside. They don't understand the rules and have zero inclination to say anyone is outside. No point arguing with people like that

                I find it bizarre that you'd rather discuss it on a public forum rather than directly with probably the one person who could actually help you here!

                    To be honest I'm not surprised. While we know exactly who Andy is its not other posters may not.

                    And the reaction from the HR department is exactly what I would expect. After all the department is a resources department its not a personal department and that name change tells you exactly how they think...

                      We've actually found HR and Finance departments open to evidence based discussions. In a lot of ways this whole topic has given us a real ability to show the value of an agency (insert jokes here)
