The agency if sensible will put a clause in their contract which states if they become liable for taxes due to your engagement then you need to pay up.

Hmm, and if they don't? Isn't it between PS client and agency to sort this between themselves - i.e client say outside, agency pays full day rate. Period.

Reason for asking is that there will be cases like the ones in the examples - genuinely outside. I somehow got the feeling it will be doom, but if the PS says 'feck it, it is outside' and the contract is watertight where is the problem.

"Should you have direct contractors that you have determined to be subject to the Intermediaries Legislation, you need to ensure that your payroll is capable of processing a ‘deemed’ payment to PSC contractors, making the deduction of employee’s NI, PAYE and remitting that to HMRC whilst reporting via RTI. In addition, as the employer you will also need to budget for the additional employer’s NI and Apprenticeship Levy, or renegotiate the supply price down."

You might also want to add in "if you have quality contractors working on projects now, better close those projects asap as those contractors are bye-bye come April. Or you can try throw more public money at unskilled workers who are more than willing to sit at a desk all day and advance nothing (i.e. Civil Servants)"
