    Hi
I've had an "officer" from the Debt Management Accelerated Payment Team knocking on my door today. I was out, but called him and he wants to come round tomorrow to establish my situation and find out what I can pay. I have been getting advice etc from Webberg, but I wanted to ask, would you know if this guy has the same powers as a bailiff? Will he be able to take my goods if I say I can't pay the debt in full? I know it's unlikely, but my brain has gone into overdrive! Thanks in advance.

Which, I suspect, was the point.

Not a Bailiff and has no powers other than to talk to you.

He will make a report to DMB and from there a decision on action is taken.

At the Big group meeting yesterday we had the benefit of a discussion with an Insolvency firm and somebody from there who, like WTT, have seen a number of people move through the APN non payment process from initial demand to not so nice letters to visits. We have both noticed that the process stalls at that point and there is a reluctance to move into legal action.

We speculate that Judges might be against issuing orders for disputed liabilities, but it's speculation.

Speak with the guy and just be honest.

discovery letter for 2011/12 and prior years

I was with the scheme that is now under an assessment penalty from 2010 to 2012 for tax years, 09/10 - 10/11 - 11/12 and I wonder now if the HMRC would also be sending me letters soon for the prior 09/10 & 10/11 years or these are now past the HMRC cutoff.

                Thanks

Lots of threads here about time limits.

If you've not had any enquiry letter or discovery assessment for 09/10 and 10/11, then it's too late now.

Update on Australians and Debt Recovery

Landscape is continually changing whioch will be challanging

This is a lawyer I have engaged in Australia for guidance

My strategy is still not to pay, I may engage for a TTP over 8-10 years, which I am sure they will reject but at least it shows I have tried.

                      Hi Woftam,

I'd be keen to hear whether Dwyer were able to help in clarifying your position and whether they had some constructive advice for you.

                      cheers
