Sunday Solutions Anyone Else Having A Problem

    I think we are all assuming two things:-
    - we were known by HMRC to be in a partnership
    - Bradbury didn't lie about submitting the returns

    I think we would be deluded in believing that anything is quite how it appears. I agree with keeping your head down - HMRC are overworked and demotivated so I believe there is a possibility that some/many of us will never hear anything from HMRC about the partnership accounts. Nyiri is grossly incompetent in his running of the companies (although admittedly rather rich) - no way am I going to provide any information to HMRC that might give rise to a bigger tax bill!

      BAD Debts

      If anyone is going to try to claim bad debt relief they would have to show that they have taken action to recover debt due by the former partnership. The HMRC people will need to have evidence that you have tried to get recovery.

      In addition the amounts retained are strictly yours( ie its not PAYE tax or VAT due to HMRC) but with condition that until the full costs due for any legitimate are agreed and determined you do not know how much you are actually due.

      So you may not be able to claim unless you can definitely say this is the final figure and given the lack of information from Mr Nyiri and the boys running by the partnerships that is the way it may have to stay. Until someone does something about it.
      If any one has done this and is found by HMRC to have taken no steps to obtain recovery H M R C might well disallow the bad debt relief.
      If you do this neglectfully or wrongly you could end up with penalties etc.

      You have 6 years to obtain recovery.

      Meanwhile has anyone been contacted by anyone claiming to be an administrator winding up a partnership?

          It isn't bad debt, it's fraud, which is treated differently from a tax perspective. My accountant advises that it isn't possible to write off fraud. However, if anyone else has other advice ...

            Sunday Solutions

            My daughters company is in the same position her tax has not been paid to the inland revenue and she has been unable to contact the company. She was told that the company was in administration and that there was nothing she could do.
            The company has not posted any intenten of going into administration or liquidation in the London Gazette and I have also spoken to Companies House. They are still trading and have no reason not to pass on your tax to the inland revenue.
            The advice I obtained from Insolvency.gov is as follows.

            Go to Insolvency.gov.uk
            On their home page click on the blue heading COMPANIES INVESTIGATION BRANCH
            Scroll down this page until you come to a list where you will find complaint form click on this and fill out the form

            London Gazette is a publication where all pending insolvency have to be notified in, as at this time neither Sunday Solutions or Bradbury & Co ltd have posted any such notification it only takes about 14 days from notification for companies house to be informed and companies house has confirmed that both these companies are still trading.

            There is no reason that you cannot take legal action against these companies as they are still trading..

                I would advise you also to write to Sunday Solutions requesting that they return to you all the monies you have paid and that you will be taking legal action if you do not receive any response within 14 days. It may gee them into action and will also proove that you have tried to recover monies from this company. You will need to send the letter recorded delivery as proof of postage.

                    "undistributed profits"

                    What on earth is "undistributed profits" anyways ?
                    I have such "profits" for the years 07/08, 08/09 and 09/10. Should I be claiming those back as well ?

                      Fraud

                      Fraud is taking by deception illegally. I would need proof of this as will anyone else
                      You lose money but you may not be able to recover it because the person committing the fraud has hidden it or something else.
                      You have a loss but you originally got paid in the case of these partnerships . However you put the money or the the money was put in the care of others. So either you or the person who put it there bears responsibility for puttting it there.
                      But their defence is they did not know someone would take it and not repay it.

                      That might not on one occasion rise to be fraud. It could be embezzellement but if they are encouraging lots of people to do this and no one gets paid their money back you may have to prove what happened first.
