This leads me to conclude there is zero point paying someone to work out the liability when HMRC will eventually have to do it for you for free. From there on in it would be more prudent to pay a specialist to check HMRC have got their figures correct.

I understand though people wanting to see their doomsday scenario and be prepared.

Nice post, good info (in the end, as Greg notes above, I think you'd want a professional to look closely at the actual liability when it arises, given the guidance from the ESM and legislation - I agree that it's very messy). Regarding the above, I reach for the face in hands smiley. Wow. Ultimately, though, if you didn't operate in this way, it should matter to the final outcome (for you).

        Hi everyone,

I have also received a letter from HMRC as a former client of Boox. It seemed to take 10 days for HMRC to get the letter to me since dating it, and a few days of me trying to work out just what was going on... My current accountant doesn't want to touch anything to do with this as Boox are apparently offering such support, but every email I send to Boox gets rejected.

Does anyone have access to a guide/template for raising an appeal to HMRC please?

I have also tried David Kirk but one week in and I'm yet to hear back other than an MSC Survivors Group opt-in email, and I'm concerned I'm running out of time here. If anyone has any recommendations for advisors to use here I'd really appreciate the info.

        Thanks

QDOS can make the appeal for you, alternatively you can use the Boox standard appeal letter. The Boox email is [email protected]. They do reply it takes time (for me around 5 days).

I'd suggest read the posts here. Also you should have both NI and PAYE HMRC letters.

Thank you for your information - that email address is different to the one published, and I have finally been able to email them!

Regarding the quoted part re two letters, this isn't the case for me - I have only one letter with a NI liability notice. It's also addressed to the old name of my company, and a chunk of my address missing. Should they both be sent at the same time, and does this impact me if I have not received the other one?

            Thanks again

But yes HMRC do forget sometimes it's a tricky one to call.
Yes so chase them up on April 6th when you still have 29 days to appeal.

For whatever reason I received the NI letter by post to my home address. The PAYE letter(s) only went to Boox, it sounds like you are in the same position, so chase Boox to make sure they are emailed across. It took five days of repeated emails.

When Boox emailed the letters today they also included the NI letter (sent to their address) and a word template appeal letter.

I'd already engaged QDOS to write / send my appeal letter. It will be interesting to see the difference between the QDOS and Boox letters.

I forgot to add, my NI and PAYE letters both had the same issue date (22/11/2022). So if yours should be the same . . .

This is all a lot to take in! I have been going through this thread that I stumbled across today, and had seen some posts about QDOS, so they were next on my list. I think it's probably my best option given the timescales, especially if Boox are taking around five days meaningfully respond.

Out of interest, have QDOS quoted you a timescale for this work?

? How would that work, the of 30 days is from the issued date isn't it? Are you saying you have 30 days from HMRC's deadline of being able to issue the determination? I'm sure you only have 30 days from the issue date.
