      I am thinking that if a religious organisation is given the right to decide one way or the other, and then they opt/choose not to allow gay marriage, then that decision could be challenged at the ECHR for being a discriminatory decision.

      But with CofE, they don't have any choice - they cannot make any decision, so cannot be challenged directly at the ECHR.

      What I don't understand is why the CoE needs this extra layer of protection - and yet other organisations do not.

                      From what I understand, the CoE are allowed to opt out of performing marriage between two homosexuals, contrary to discriminiation laws.

                      Businesses are not allowed to opt out of discrimination laws.
