    Either way I think it's crazy that someone with nice business making £250k profit would do such things - he could have easily doubled customer base if he was marketing himself properly.

          Sure, I agree with you but HMRCs view is I signed off for him to be my representative to them therefore he is acting on my behalf. Now the trick is they didn't think I owed them anything, so he's not taking money offset against a debt, he is taking a credit (I put into the system after getting notice from darren of what was due) out of the system. He sends them a letter pretending I urgently need the money giving them new bank account details (his) but under my company name. Now the fact they didnt match what HMRC had on record for my bank details does not seem to be an issue to them (they dont have any compunction to check apparently).

          Now the crunch is when HMRC realise that a proper return was due, there is now a deficit in the account which I have to refund, they wont chase darren for this as they see it as my problem and not theirs.
          The court heard Darren Upton had written a letter to Judge Sally Cahill QC saying he wasn’t “a typical inmate of prison”.

          But the judge said: “That simply demonstrates your arrogance continues. You are typical. Inmates of prison are people who are dishonest. You are a thoroughly dishonestly man motivated by your own selfish greed.”

              If someone defrauded HMRC it's that persons responsibility and they should be chasing money off him via police route: certainly when money actually reached HMRC bank account and fraudster in question got it back to their own!

                  Of course I agree but from what I have been told HMRC have no duty of care. I have heard of individuals taking them to court over similar issues and winning but the upshot is they then become VERY interested in you. I don't fancy fighting them off for several years.

                  I doubt it, but thanks for the support.

                  PS he gave me his bank details first (the way it turns out he conned most), I looked at them and recognised them as not being HMRC and asked him WTF. He said he pasted them in by mistake. I sent the funds myself using the details on the payslip. Obviously that wasn't the end of the matter as he took it out of the HMRC account.

                      Firstly you MUST sign up to online services so you can monitor the corp tax account. If I had done this I would have seen a null return had been submitted although I would probably of thought it was an HMRC cock up (as I trusted Darren).

                      Now when corp tax is paid I monitor the account closely, anything odd I will contact HMRC immediately.
