Albany - Having Problems??

    oh dear, I hate to write this but I've been there and stood in that queue, I'm still owed £9k from October 2008, Administrators have eaten up whatever financial remains there was left of the payout deal that was put to use and I'm resigned to the fact that at extreme very best the most I'll see of that £9k is possibly £200 but even then I doubt it.

    In hindsight I should have sent a letter the day the debt was overdue, followed it up with a second letter stating small claims court proceedings are taking place and then gone through small claims without delay to salvage whatever I could. I believe now they've announced Administration then there is little to do other than makes plans to assume you'll get none of that debt back and if you do receive anything it will be a very small percentage of debt that you're owed. Although I am not a lawyer and so it is best to seek legal advice rather than rely on my knowledge.

    good luck and if it's a large amount seek legal advice IMMEDIATELY.

      Well that's us all up s-street!

      Only good thing about this is I'm glad I only got Decembers pay with them, and I took 2 weeks off!

          Maybe administrators should only get their fee if there's enough assets to cover all the actual creditors, otherwise they should persue the individuals hiding behind the company for personal liability. Far too easy for the directors to walk away from the mess, having taken large sums of money out of the company, money that they should have no legal right to unless they've paid what the company owes first.

          Something else I'd like is some way of being able to offset these types of losses (i.e. bad debts) against tax, like some form of expense incurred for doing the work but not getting paid for it. Maybe there is and I don't know about it?

            Sympathies to the guys who've lost money, of course. But this just adds fuel to my long held suspicions that these man co type things are just parasites to be avoided at all costs? At least invoicing from my own Ltd to the agency and getting paid weekly, it limits my losses to no more than 1 week. I'd likely walk away if the agency missed a payment in this climate and I'd try to get the client to switch to another agency if possible. I guess a lot of agencies are really struggling just now too?

                  I agree, current gig is via "in house agency", so effectively is direct. There are a few agencies that I know that are pretty sound though.

                    what to do next?

                    I am owed pay for the whole of January 2010. Now that Albany have said they are going into administration, does anyone actually know who I can contact to get paid my wages? (phone lines at AMUK are dead, and no replies to emails - I`m guessing the staff have been sacked).
                    What moves can I make to try to get the money that I am owed by AMUK, if any? Reading through the threads people seem to be resigned to the fact that their hard earned cash is lost...surely there must be a way of getting paid what we are owed.

                      Albany probs

                      Looks lik we are all stuffed. The problem is that if the contract is not terminated can Albany still invoice the client although I have not submitted timesheets?
                      The only thing to do is to bite the bullet, say bye bye to the money, terminate the Albany contract, and not take up the Von Essen offer but get a contract with the client direct.
                      any opinons on this?
