    Albany : Technologies or EMEA ?

    that only 3 Albany companies are concerned.

    Alabnay Technology would not. But I know they refuse new contractors and I was contacted by Von Essen consulting who's taking over they current contrats.

    Is someone encounte problems with Albany Technologies - in my case, In Belgium.

      Von essen are winding down their UK operation as of this weekend. Odd that they are touting for new business.

        The 3 companies were the ones with all the money....the 4 guys in my team were all with Albany Tech and they have not been paid for Dec or Jan even though client co has paid Albany.

        Hopefully you are not in the Mirasol split as well as those people seem to have lost everything that was in the fund.

          I am wondering if at some stage these payroll companies and agencies themselves even will fall under the control of the FSA

            Albany Situation

            Hello,

            I´ve been working with Albany for a couple of years and have had a very good experience (until now).

            They now owe me two months invoices, can´t really seem to find anyone to talk to though. Does anyone know who´s holding Albany´s bank accounts at the moment : they are holding my money....

            Perhaps it´s time to organise something to ensure single contractors debts are payed out, I´d hate to see my money dissapearing into RBS just because they feel like they can take it. It´s not theirs to take, in my opinion....

            How does one deal with situations like this...It´s a first for me and I have no idea what to do next.....

              Update

              I'm in the same situation as you. I haven't seen any money since Dec'09 and I managed to speak with Jade Steward at Albany UK this morning but she said there is still no update when they going to pay
              I thing we shoud get together and sue them as they got no rights to keep the money, but I'm not sure if there is someone who can offer any legal help here please...

                Not sure if suing (or any other form of legal action) will work if they simply don't have the money to pay you.

                Very frustrating situation, but that's the deal with Ltd companies, they can limit their incompetence to the company, not those running it.

                So even if the directors have withdrawn millions from the company (as the Glazers are doing with Man U) you can't get it back off them, unless it can be proven in court they've been operating illegally (such as trading while insolvent), and even then I doubt it'll be a cheap course of action with all the lawyers/court fees that are not guaranteed to be recoverable.


                On the plus side if HMRC ever come along with their IR35 hat on saying I'm a disguised employee, I can tell them where to stuff it. This scenario proves I'm not due to the risk I've exposed myself to and fallen foul of.

                  First step = what does your contract say. Are you an employee of Albany or a self employed consultant.
                  If it the former, then you will get your salary, if its the latter, then get in line with the rest of the unsecured creditors.

                    I went to Citizen's Advice about this last week, and their opinion was that while I could take Albany through the Small Claims Court to try to get my money, if Albany just don't have the money, then they won't be able to pay.

                    So, I'm not sure what else we can actually do...

                    I've been e-mailing them every day, to the point of even copying in one of their directors to try to get some kind of response, but I'm hardly getting anything back.

                      OK, that´s the thing : I´m self employed so probably need to get in line, the questions in my case are ´where´s the line ? ´ and ´how do I get in it´

                      Still : it´s money I worked for, it feels incorrect that that money should be used to settle part of a debt Albany may have with other parties. Only Albany´s part of that (their management fee) should be taken for that purpose. But I guess I´m being naive.

                      And then it all depends if this is full scale bankrupcy (I think it is) or if they manage to continue working somehow (I doubt it...unless some Big Investor jumps in and settles debts for them, which seems rather unlikely)
