British vessels however were in international waters.

It's not a fallacy; the regulation stands - the EU is obligated to intervene if a vessel is destined to a country under sanction, when in EU waters.

The ship went through Spanish waters and they did not stop it. It was only when it entered UK waters that we stepped in, under orders from the US (not the EU).
